On 12th March, 2012 there was a little smile of relief on the faces of residents of B.K. Dutt Colony. Delhi High Court after listening to the Petitioner gave an order to maintain peace and harmony in the colony. It happened after 7 years (from 2005) that High Court gave some relief to the people. It happened immediately after the arrest of Syed Ahmed Kazmi who is in 20 days police custody for planning and helping the terrorists for the Israel Bomb Blast on 13 February. The residents of B.K. Dutt Colony was in shock when they heard that such kind of person was staying in the colony, and were doubtful about their security.
Hon'ble High gave the order to (1) THE MATTER SHOULD BE SENT TO MEDIATION; (2) WESTERN GATE SHOULD BE CLOSED; (3) STATUS QUO SHOULD BE MAINTAINED

5. Liberty is also given to the parties to approach the Court if some interim directions become necessary.

Order as under :
1. The counsels for the parties agree that the matter be sent to Mediation and Conciliation Centre of this Court to explore the possibility of amicable settlement. In the mediation proceedings, representative of Resident Welfare Association shall also participate. Mr. Kirti Uppal, learned senior counsel for the petitioners would ensure their presence.
2. Accordingly, matter be sent to Mediation and Conciliation Centre of this Court and the parties are directed to appear before the same on 19th March, 2012 at 0330 hours. Since the parties have already agreed to find an amicable solution to the problem, it is expected that both the parties shall maintain peace. The SHO of the concerned area shall also ensure that any procession etc. which are to be taken out in the meantime are held in a peaceful manner and no untoward incident takes place.
3. In order to create conducive atmosphere, we also direct status quo as of today to be maintained during the conciliation proceedings. Learned counsel for Delhi Police also informs that insofar as Western Gate is concerned, the same was lying closed for the last 25 years and opened only on 14.01.2012 and which may be a cause of some concern. The said gate shall also be closed till the pendency of conciliation proceedings.
4. We make it clear that by issuing these directions, we have not gone into the merits of the respective case and this interim arrangement is made only to facilitate mediation proceedings. We may also place on record that Ms. Tasneem Ahmadi, learned counsel argues that Western Gate forms part of the wakf property and was not lying closed but was mischievously recently got closed by the SHO and got reopened on intervention of DCP. The same is disputed by the other side.
NOW WE ALL HOPE THAT THE HON'BLE COURT WILL DO THE JUSTICE AND PUNISH THE PEOPLE WHO DISTURBED THE PEACE OF B.K. DUTT COLONY
