WAKF BOARD PLAN EXPOSED

In the case of Wakf Board/Anjuman-e-Haidri V/s Nursery at Karbala Grounds, Wakf Board's plan of misguiding and grabbing of land exposed in Hon'ble Delhi High Court exposed.

Wakf Board in their affidavit showed that the land has been given to Nursey on lease basis. Later on they changed their statement in another affidavit that the land was given on Licence Agreement.

The question is that how a Lessee can give land to third person on lease? Why the land which has been given on lease, is used for commercial purpose? Why the Govt. agencies are keeping silent on this malafide act of Wakf Board?

ACTIVE B.K. DUTT COLONY RESIDENTS

In the summer holidays of 2012 a workshop has been organised for people of all ages in Charbagh from 11 June to 25 June. People who attended the workshop felt relief in their Cervical, Blood Pressure, Sugar, Joint Pains and Back Problem. Seeing the need of exercise for women & men the workshop has been extended and is still going on. The residents of B.K. Now the Charbagh has become a Health Fitness Hub, as on one side the traditional yoga classes are going on and on the other hand a Workshop with Modern Techniques in Stretching, Strengthening, plyometrics and Full Body Exercises are gaining popularity day by day.

This Workshop is designed by Experts like Dr. Kishan Lal Sharma, Sanjay Gandhi, Anil Chowdhary, Mandeep Phokela, Ajay Chowdhary, Vinod Sharma, Hari Gautam, Gulshan Khurana etc.

It is unpleasant to hear that Delhi Govt. is trying hard to get the FIR quash which was lodged against the associates of Anjuman-e-Haidri, Dargah Shah-e-Mardan, B.K. Dutt Colony, New Delhi-110003. The associates of AeH are land grabbers and in the garb of religion they are using political pressure to grab the lands.

Delhi Police objected on quashing the FIR which is very much right, because the quashing of the FIR not only will bring harassment to Delhi Police personnel but make the miscreant over confident and use their power over Delhi Police in future also. The ill motive of Delhi Government is exposed now and they don't worry about the self respect of Delhi Police also. In the mode of discrimination the govt. can go to any extent to benefit the miscreants. 

In this regard, we, B.K. Dutt Colony Youth Association along with RWA and residents of B.K. Dutt Colony demonostrated today on 28th July 2012 at Safdarjung Airport Service Lane to express our grave objection and oppose the quashing of the FIR to save the dignity of Delhi Police and to maintain peace and harmony of our B.K. Dutt Colony. Sh. Ram Bhaj, Ex. MLA, Nitin Sardare, Harbans Dankal, Anil Chowdhary, Madan Bhutani, S.C. Maini, Mahender and Ajay Chowdhary (Gen. Secretary, Youth Association) addressed the people.

It is quite obvious that in the reign of Mugals all the properties were snatched from Hindus. And all the muslim properties were of Hindus before the Mughals. So why their claim is taken so seriously.

PROCEEDINGS OF 2ND AND 5TH JULY

MEDIATION 2ND JULY

Mediation was held on 2nd July at Minority Commission, Khan Market, under the Mediatorship of Mr. Wajahat Habibullah (of Minority Commission) and Mr. Nigam (of DDA).  It can easily be concluded who Mr. Habibullah is. He gave directions to NDMC to break the newly constructed wall and make a passage for land grabber to continue their process of land grabbing in the garb of religion. How can fair mediation can be expected from Mr. Wajahat. In the mediation he tried to do as per his plan. But being opposed by the residents of B.K. Dutt Colony he was not able to do so. Does not we have any right to live peacefully? After the warm arguments with Anjuman-e-Haidri and their crook associates the Mediators finally gave the instructions to Govt. agencies to submit their status about the land title.


COURT PROCEEDINGS 5TH JULY

In the court doubt was raised in everybody's mind that the Court is working under the pressure of politicians, and their doubt is not wrong because the Judges were not in mood to listen to any prayer of Petitioners. It is a joke in Indian Judiciary that the petitioners are deprived of their rights and the culprits are saved by the Courts. The Judges, despite all objections and arguments by petitioners, gave permanent permission to Anjuman-e-Haidri to do Nauchandi once in a month with all conditions as earlier. The biggest surprise is that the Court is not considering any documents, any fact, submitted by petitioners which CLEARLY SAYS that all lands belongs to Govt. agencies. Shame for Judiciary.

CONSTRUCTION OF BOUNDARY WALL

By the order of Hon'ble High Court, on the demand of Anjuman-e-Haidri the NDMC started the work of Boundary wall at Kanati and L&DO Park behind K Block. The work carried out on 6 June and 8th June, 2012.

AeH requested CM Shiela Dixit and Sh. Ahmad Patel to stop the work and allow them to grab the land as per their plan.


The work has been stopped due to political pressure. It's not difficult to guess who's pressure it is. The Anjuman-e-Haidri tried to stop the work because the work was not carried out as per their plan. The malafide intention can easily be judged as the contractor who got the tender is one of the associate of Anjuman-e-Haidri.

Now the AeH is organising a new kind of function on 19th June 2012 and in the garb of that function they will try to break the wall so that they can again enter into the govt. land in the garb of religion and start grabbing the land.
We are looking forward to Delhi Police, NDMC and L&DO to save the land.

MEDIATION 4th May, 2012

Today was the Mediation Date for the B.K. Dutt Colony Case. Nothing happened today and the next date of Mediation is set for 11.05.2012 i.e. next Friday.



There is one more issue came into light, though it is 9 years old, but raises a doubt on the working style of the advocates in the System. This came in the India Today Magazine January 20, 2003 issue under heading "Rot in the System" regarding malpractices in the judiciary. 

In the Delhi High Court, there are a dozen judges (out of 30) whose offsprings and wives practise in the same court. And barring a few, their lordships stay with their lawyer-relatives. During A.M. Ahmadi's tenure as CJI, his daughter Tasneem had a roaring practice in the Delhi High Court. The Committee on Judicial Accountability alleged that she was "using" her connection to get favourable ruling and demanded, as a remedial measure, that Tasneem and her father should not live in the same house. The demand went unheeded. Why this article important? Because Ms. Tasneem Ahmadi is the advocate for Anjuman-e-Haidri in our case. So cannot it be imagined that how she got so many favourable orders for AeH in the past in our case? Just think!!

FIRST TIME IN 7 YEARS VOICE OF RESIDENTS IS HEARD

On 12th March, 2012 there was a little smile of relief on the faces of residents of B.K. Dutt Colony. Delhi High Court after listening to the Petitioner gave an order to maintain peace and harmony in the colony. It happened after 7 years (from 2005) that High Court gave some relief to the people. It happened immediately after the arrest of Syed Ahmed Kazmi who is in 20 days police custody for planning and helping the terrorists for the Israel Bomb Blast on 13 February. The residents of B.K. Dutt Colony was in shock when they heard that such kind of person was staying in the colony, and were doubtful about their security. 



Hon'ble High gave the order to (1) THE MATTER SHOULD BE SENT TO MEDIATION; (2) WESTERN GATE SHOULD BE CLOSED; (3) STATUS QUO SHOULD BE MAINTAINED 


Order as under :

1.     The counsels for the parties agree that the matter be sent to Mediation and Conciliation Centre of this Court to explore the possibility of amicable settlement. In the mediation proceedings, representative of Resident Welfare Association shall also participate. Mr. Kirti Uppal, learned senior counsel for the petitioners would ensure their presence.

2.     Accordingly, matter be sent to Mediation and Conciliation Centre of this Court and the parties are directed to appear before the same on 19^th March, 2012 at 0330 hours. Since the parties have already agreed to find an amicable solution to the problem, it is expected that both the parties shall maintain peace. The SHO of the concerned area shall also ensure that any procession etc. which are to be taken out in the meantime are held in a peaceful manner and no untoward incident takes place.

3.     In order to create conducive atmosphere, we also direct status quo as of today to be maintained during the conciliation proceedings. Learned counsel for Delhi Police also informs that insofar as Western Gate is concerned, the same was lying closed for the last 25 years and opened only on 14.01.2012 and which may be a cause of some concern. The said gate shall also be closed till the pendency of conciliation proceedings.

4.     We make it clear that by issuing these directions, we have not gone into the merits of the respective case and this interim arrangement is made only to facilitate mediation proceedings. We may also place on record that Ms. Tasneem Ahmadi, learned counsel argues that Western Gate forms part of the wakf property and was not lying closed but was mischievously recently got closed by the SHO and got reopened on intervention of DCP. The same is disputed by the other side.

5. Liberty is also given to the parties to approach the Court if some interim directions become necessary.

NOW WE ALL HOPE THAT THE HON'BLE COURT WILL DO THE JUSTICE AND PUNISH THE PEOPLE WHO DISTURBED THE PEACE OF B.K. DUTT COLONY

ANOTHER SITE GRABBED IN THE GARB OF RELIGION

From last few days Anjuman Haidri started cleaning the old structure. Residents went to the High Court but  the court is silent. The court issues notices on our application but "No directions are given to any govt agency to protect govt. lands". 

 This incident happened on 01.03.2012 when Anjuman haideri called people from outside. In the garb of the Nauchandi Raat these people gave a religious colour to the old khandhar i.e. the alleged 'nakkar khaana'. The ladies started offering namaz at the old khandar near 'G' and 'F' block. On objection by the residents, Police force deputed but neither the Police stopped the religious drama nor the Anjuman-e-

Haidri showed any permission to do so at that site. After a while when residents were standing peacefully at the DDA land, police under pressure from the political leaders started pushing people from the place so that miscreants will be free to do anything they want. The new dispute gaining eyes of every newspaper now.  

Another question came into existence as how the SHO got transferred before his tenure and being aware of the fact that he was very much aware of the case and did his best to maintain peace in the colony.

CONSPIRACY AGAINST HINDUS IN DELHI

ENCROACHMENT WITH THE HELP OF GOVT. AGENCIES?

Taking advantage of the time gap in the next date of hearing; Yesterday on 26.02.2012 the Office Bearers/Representatives of the Anjuman Haidri planned to capture land behind the 'G' Block i.e. Old Khandhar  falsely claimed as "Nakkar Khana" The said old khandar was never in possession of any body i.e. Govt. agency/semi govt. agency or any private organization since its inception i.e. before the partition of India in 1947 and never been used for any kind of religious activity by any body.

Surprisingly the DDA and L&DO have not filed their reports and affidavits despite of the court orders of  01.02.2012 which were passed by the Hon'ble  Division Bench Of Justice A.K Sekri and Justice Rajiv Sahai Endlaw. stating:- 

1. In the counter affidavits to be filed by the respondents DDA and L&DO, it would be specifically stated as to which area, after demarcation is in the occupation of the respondents DDA/L&DO and how these authorities are proposing to deal with that area keeping in view the provisions of the Master Plan. The demarcation reports shall also be filed along with the counter affidavits.

2. In the counter affidavit which shall be filed by the respondent Delhi Police, the Delhi Police shall specifically advert to the issue of law and order and how it proposes to maintain peace in the said area.

Yesterday senior officers of Delhi Police and Mr Inderjit Singh Addl. Director, DDA along with J.E. Mr. Chauhan called for a joint meeting in a temporary control room of Delhi Police located in the locality. Several discussions were held during that time and representatives of the B.K. Dutt Colony requested all the officers present at the situation that no action should be taken by any of the agency and law and order should be maintained till the next date of hearing i.e. 12.03.2012 before the Hon'ble High Court. But residents were shocked to see at once as soon as the residents had left the meeting, the police /DDA Officers came into action to get the old khandhar cleaned through the labour belongs to Anjuman-e-Haidri on the advise of Mr. Syed Bahadur Abbas Naqvi. Later on residents requested again and again to the senior officers of Delhi Police and DDA to stop the action but all the requests went in vain. It seems that Police was deployed to let Anjuman-e-Haidri encroach upon the old khandhar.

B.K. Dutt Colony is an exact example where law is in the hands of Land Mafia. The NDMC deliberately neglected govt. lands in B.K. Dutt Colony from 1970 onwards so that the Land Mafia can encroach upon it . Now NDMC seems to be alert for some activity. NDMC called tenders for construction of boundary wall in Karbala. In its tender it has not specified any site or any layout plan for the construction. The doubt is that the boundary wall will be made in such a way that three sides will be covered and the wall towards Dargah or Karbla (Kabristan) will be kept open to enable AeH to encroach upon it. The next date of hearing is 12^th March, 2012. Date of Tender is 24^th February 2012. The question are

• WHY NDMC IS IN SO HURRY TO ISSUE THE TENDER?
• On whose instructions NDMC is doing this?
• Why NDMC is not waiting for Status Report of L&DO and DDA in Court?

Any person can easily understand the malice of NDMC.

The social activists all over Delhi are now supporting B.K. Dutt Colony Vikas Samiti which is fighting for their Fundamental Rights against the Land Grabbers. Supported and cooperated by the residents of colony the Samiti decided to fight the battle to the end for their rights. Not only residents are in support but other social activist from all over Delhi viz Jangpura, Defence Colony, Lajpat Nagar, Jor Bagh, R.K. Puram because B.K. Dutt Colony is not the only colony fighting against this corruption and discrimination the whole Delhi and rather India is victim of vote politics. Vishwa Hindu Parishad (VHP), Bharat Dharam Jagran, Bajrang Dal, Shiv Sena are also in support of Samiti.

As the Congress party is uncovered now that (photographs below) how Digvijay Singh, Shiela Dixit and Rama Dhawan are compromising with the constitution and suppressing rights of majority for minority; their love towards minority class is not hidden anymore. Salman Khurshid, Digvijay Singh, Shiela Dixit, Rama Dhawan, Gulam Nabi Azad and new born Beni Prasad Verma and their team is trying hard to CONVERT THIS NATION INTO COWARDS by various means like reservation, reservation under reservation.

Even after bringing into notice of Hon'ble Court this is surprising that neither the Contempt was ordered against the culprits, neither they are arrested after the riots of 15.01.2012, nor the Hon'ble Court is taking into consideration the REAL FACTS regarding titleship of land. Then why should not it be called 

JUSTICE DELAYED IS JUSTICE DENIED.

Digvijay urges Jawwad to withdraw protest call against Congress 

In wake of protest call given by Maulana Kalbe Jawwad against Congress party, the Congress general secretary Digvijay Singh rushed to meet the eminent Shia cleric in Lucknow on Wednesday.

Maulana Jawwad had given a call for demonstration outside Congress party offices from Friday to protest against police action on devotees at Shah-e-Mardan Karabala in BK Dutt Colony, Jor Bagh at New Delhi on January 15, 2012. Police had lodged an FIR against the clerics and used tear gas shells to control the surging mob of devotees in Jor Bagh on that day.


Realising that the protest call by Jawwad will alienate the Congress from Muslims, Singh rushed in a damage control exercise and pacified the cleric on Wednesday. Digvijay arrived nearly half an hour before his scheduled time to meet Jawwad who was not present in the house however he patiently waited for the cleric.


During the interaction Jawwad handed him over the papers and other related documents of the shrine Shah-e-Mardan at New Delhi. Jawwad placed demands for construction of a boundary wall, expunging the FIR lodged by police which has named several clerics for instigating violence, removing the nursery set up in a portion of the shrine and compliance of the High Court's directives for complete possession of the shrine. Muslims already have the possession of the shrine and the controversial closure of western gate has also been resolved with Delhi government handing over its keys to the clerics.


Digvijay assured that the demands will be considered sympathetically. "Congress is concerned about the issues related to minorities. All efforts will be done to settle the issues raised during the discussion," said Digvijay. He also urged the cleric to take back the protest call against Congress as his demands are already under consideration and will be fulfilled. "We need to take confidence building measures so that the Muslims feel empowered and are in the mainstream of the country. No action should be taken which has adverse impact on their esteem," said Digvijay.


Talking to newsmen after the interaction, Maulana Jawwad stated that he has handed over the papers and other related documents to Digvijay Singh and it is up to him to take action for resolving the issue. Over the possibility of supporting Congress, Jawwad stated that he is nonpolitical person and as such is not involved in issuing appeal. "If our issues are settled our community very well understands who has helped them. It is a natural phenomenon that they will then support those who had helped them," said Jawwad. He however claimed that the protest call from Friday against Congress was still valid and they are awaiting reply from the Delhi government.

It seems that KALBE JAWWAD is also MISLEAD by ANJUMAN-E-HAIDRI. AeH is using KALBE JAWWAD for its MALAFIDE PURPOSE of LAND GRABBING

New Delhi: The Delhi high court on Wednesday sought the original files from the Delhi Development Authority and the state government relating to land allotted to a shrine in south Delhi's Jor Bagh area and its management.

HC was hearing a public interest litigation filed by residents of B K Dutt Colony, alleging that some people had encroached public land in the name of performing religious works and had indulged in violence against them. On January 15, at least 25 people, including a woman and some police officers, were injured in clashes between police and Shia mourners, who wanted to enter the shrine. A division bench of Acting Chief Justice A K Sikri and Justice Rajiv Sahai Endlaw also directed the station house officer concerned to ensure there is no law and order problem in the area.

The residents are living in fear but the police have not been able to protect them, the petition said. "Police have actively collaborated with the outsiders to grab the space within the colony owned by the government," the petition alleged.

According to the petitioners, the outsiders have allegedly attempted to intimidate the residents of the colony by foisting false cases on them and using the police to threaten and harass them.

Whereas people present inside the courtroom have seen clearly that how the counsel of miscreants associates of Anjuman-e-Haidri  was trying to turn the whole land grabbing issue into religious way. She was seen covering all mischiefs under religious cover.

Story of B.K. Dutt Colony

On 15 January 2012, Colony witnessed  large- scale violence inflicted by representatives of Anjumen-e- Haidri instigating thousands of people gathered there to participate in religious function Chehullam. On that very same day, in the afternoon they grabbed some the open lands/parks, which were used by the residents for the last 60 years as such. Notice board were fixed by them misinterpreting the Order of Hon’ble Delhi High Court deliberately (it is very shocking that hoe they got the copy of order whereas the copy was available over internet on 17th January? On whom finger can be raised?). 

Protested by the residents, and  police interference went in vain. A well organized and orchestrated violence broke out. they started stone-pelting  damaged public property in a free for all. Lots of police officers were injured in that deliberately planned event. But it looked that they were working under hidden guidance and pressure.

All this happened due to false claim of Anjumen-e Haideri over Govt lands/parks as the records i.e  revenue, RTI, L & D O affidavit prove. Nothing had happened for the last 60 years. 

They filed a petition in 2005 berfore Hon’ble Delhi High Court. Order was given for Demarcation and construction of boundary wall to protect waqf land (i.e. Dargah Shah e Mardan itself and not the surrounding land). Matter was disposed and order was complied with by NDMC in 2006. On 11.1.2012 same order was confirmed yet again by the Hon’ble Delhi High Court. 

At the time of demarcation none of residents was taken into confidence. Residents believe that Government authorities in the guise of demarcation of areas would handover parks/ lands which formed an integral part of the colony and reserved for use of the residents since its inception. Latest development in this series is the tender of NDMC for construction of Boundary wall in B.K. Dutt Colony. It is clearly evident that something wrong is bound to be committed by the authorities under heavy influential political pressure. (It is sure that problem is going to be more worse because of Election of Uttar Pradesh as Congress on any cost wants to win the election for which they even wants to give unconstitutional reservation to minorities sacrificing the rights of majority of the country - it's a simple Vote Politics)

Anjumen- e-haidri is trying to resolve this matter by exploiting the  innocent devotees. Earlier, only 3 to 4 festivals used  to be organized in year, but now there is no end to it. Now these are organized on regular basis at the disputed sites. Outsiders come in large numbers in form procession  shouting slogans, like “karbla khali karo”.

WHY THE JUDICIARY IS SILENT ON THE ISSUE AFTER SEEING THE FACTS? WHAT WILL HAPPEN TO THIS COUNTRY  IF THE PEOPLE WILL NOT ARISE FOR THEIR RIGHTS - They will have to run from every battlefield. We have to learn from India's Partition (millions had to flew from there to save life), Jammu & Kashmir (thousands of Kashmiri pandits had to leave their houses and properties to save life), Old Delhi(residents left their home due to continuous disturbance and non-cooperative behaviour of govt. agencies).
